This Privacy Policy discloses the privacy practices of JPJ Ventures, LLC d/b/a iScribeHealth (“we”, “our” or “us”) with respect to www.iscribehealth.com and any related sites we operate (the “Site”). This Privacy Policy applies only to the Site. It does not apply to the iScribeHealth software application or enterprise management console (the “Product”), which is governed by a separate End User License Agreement and any related product-level privacy terms presented to you at the time of Product signup or use.

What Information We Collect

The types of information that we collect through the Site fall under two general categories: personally identifiable information (“PII”) and non-personally identifiable information (“non-PII”). PII consists of any information which can be used to specifically identify you as an individual, whereas non-PII consists of aggregate information or any information that does not reveal your identity. The following sections describe how your PII and non-PII are collected through the Site, and how we use such information.

How We Collect and Use Information

If you fill out a form on the Site — for example, to request a demo, contact us, or sign up for our newsletter — we collect the information you provide, such as your name, email address, phone number, organization, and any message or details you include.

We use your email address for promotional purposes (e.g., newsletters, new product offerings, event notifications, special third-party offers). Email messages we send you may contain code that enables our database to track your usage of the emails, including whether the email was opened and what links (if any) were clicked. If you would rather not receive promotional emails from us, please see the section below labeled “Choice/Opt-Out”. We reserve the right to send you certain communications, such as service announcements and administrative messages, without offering you the opportunity to opt out of receiving them.

We track usage of the Site on our servers through log files. We may use this information in order to administer the Site, prevent fraud, track visitor movement in the aggregate, and gather broad demographic information that is non-PII (such as your IP address, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks).

We use cookies to keep track of some types of information while you are using the Site. Cookies are small data files placed on your computer, and they allow us to do things like count the number of visitors, distinguish repeat visitors from new visitors, save preferences, and track visitor trends. You may set your browser to disable cookies, but allowing them will improve your experience and may be necessary for you to use the full functionality of the Site. We use both session cookies, which do not persist after you close your browser, and persistent cookies, which are stored on your computer’s hard drive. We do not link the information we store in cookies to any PII.

We use certain third-party web analytics services, and those third-party analytics services use cookies to help us analyze how visitors use the Site. The information generated by the cookie about your use of the Site (including your IP address) will be transmitted to and stored by those third-party providers on servers in the United States. This information is used to evaluate use of the Site, compile reports on Site activity, and provide other services relating to website activity and internet usage. Our third-party providers may also transfer this information to other third parties where required to do so by law, or where such third parties are subcontracted to process the information after obtaining our consent. These third-party providers will not associate your IP address with any other data they hold. As stated above, you may refuse the use of cookies by adjusting your browser settings; however, please note that if you do this you may not be able to use the full functionality of the Site. By using the Site, you consent to the processing of data about you in the manner and for the purposes set out above. Our agreements with these third-party providers require at a minimum the same standards of protection and care as set forth in this Privacy Policy.

We may provide a referral feature on the Site to enable you to tell a friend or colleague about iScribeHealth, in which case we will ask you for your friend’s name and email address and send your friend a one-time email inviting them to learn more about iScribeHealth. We will store that information for the sole purpose of sending that one-time email and tracking the success of the referral feature.

Signing Up for the Product

If you choose to sign up for the iScribeHealth Product through the Site, you will be directed to our enterprise management console — a part of the Product, not the Site — to create and manage your account. Information you provide during that signup process (such as account credentials, organizational information, and billing information) is collected and used as part of the Product, governed by our End User License Agreement and any privacy terms presented to you at that time, and is not governed by this Privacy Policy.

No Protected Health Information on the Site

The Site is not designed or intended to collect Protected Health Information (“PHI”), as defined under the Health Insurance Portability and Accountability Act (“HIPAA”). Please do not submit PHI or other sensitive patient information through the Site’s contact, demo request, newsletter sign-up, or referral forms.

Who We Serve; International Visitors

The Site and the Product are designed for, and offered to, healthcare providers, organizations, and other users located in the United States. While the Site may be accessible to visitors located outside the United States, we do not direct the Site to, or specifically market to, individuals outside the United States, and we make no representation that the Site or Product is appropriate or available for use in other locations.

If you access the Site from outside the United States, please be aware that information you provide will be transferred to, stored, and processed in the United States, where our servers are located and where data protection laws may differ from those of your jurisdiction. By using the Site, you consent to this transfer, storage, and processing of your information in the United States.

Disclosure of Your Information to Third Parties

We will only share your information with third parties in the ways described in this Privacy Policy.

We may disclose information you provide (including your PII) if required to do so by law, at the request of a third party, or if we, in our sole discretion, believe that disclosure is (1) permitted or required by law, requests or orders from law enforcement, or any legal process (whether or not such disclosure is required by applicable law); or (2) reasonable to protect or defend the rights or property of us or a third party.

We may share your non-PII with third parties, but not in a manner that would reveal your identity. We may share your PII, sometimes in conjunction with your non-PII, with service providers associated with us to perform functions on our behalf — for example, email delivery, form processing, hosting, or analytics providers. Your information will be treated as private and confidential by such service providers and not used for any purpose other than what we authorize. From time to time, we may also share PII (such as email or mailing addresses) collected through the Site with carefully selected third parties so they can offer goods and services we believe may be of interest to you. If you do not wish to receive offers from our trusted partners, you can change your preferences at any time by following the steps outlined in the “Choice/Opt-Out” section below.

As we develop our business, we may buy or sell assets and, depending on the transaction, your PII may be one of the transferred assets. If we are acquired by another company, your PII may be part of the assets transferred to the acquiring party. If this occurs, we will notify you of any material changes to how your PII is collected or used.

Third-Party Advertising

We do not sell or lease your personal information to unaffiliated third parties for money. From time to time we may share your information with affiliated companies whose products we feel may be of interest to you, and, as described in the “California and Other U.S. State Privacy Rights” section below, some data-sharing arrangements with advertising or analytics partners may be considered a “sale” or “sharing” of personal information under certain state laws even though no money changes hands.

We may use third-party advertising companies to serve ads when you visit the Site. These companies may use non-personal information (not your name, address, email address, or telephone number) about your visits to this and other websites to provide advertisements about goods and services of interest to you.

Age Restrictions

The Site is not directed to children, and we do not knowingly collect personal information through the Site from anyone under the age of 13. In compliance with the Children’s Online Privacy Protection Act, any information we become aware was submitted by a user under the age of 13 will be purged from our database. Consistent with our Terms and Conditions, the Site is intended for use by individuals who are at least 18 years old.

Security

We exercise reasonable care in providing secure transmission of information between your computer and our servers, but given that no information transmitted over the internet can be guaranteed 100% secure, we cannot ensure or warrant the security of any information transmitted to us over the internet and accept no liability for any unintentional disclosure.

Links to Other Sites

The Site may contain links to third-party websites. We do not control and are not responsible for the privacy practices of, or information collected by, any third parties, including affiliated or co-branded websites that link to or advertise on the Site.

Choice/Opt-Out

You may use the following options to opt out of receiving promotional emails and newsletters from us:

  • Click the “unsubscribe” link at the bottom of any promotional email; or
  • Contact us using the information in the “Contacting Us” section below.

California and Other U.S. State Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, “CCPA”), gives you the following rights with respect to your personal information, subject to certain exceptions:

To exercise any of these rights, please contact us using the information in the “Contacting Us” section below. We will need to verify your identity before fulfilling your request, using information proportionate to the sensitivity of the request. We will acknowledge your request and respond within the timeframes required by the CCPA.

Residents of other U.S. states with comprehensive privacy laws (for example, Virginia, Colorado, Connecticut, Utah, and Texas) may have similar rights under their applicable state law. Please contact us using the information below to exercise any such rights.

Separately, pursuant to Section 1798.83 of the California Civil Code, residents of California who have an established business relationship with us have the right to request certain information regarding the types of personal information we share with third parties for the third parties’ direct marketing purposes and the identities of those third parties, once per calendar year. To make such a request, please contact us using the information in the “Contacting Us” section below, and we will respond within 30 days as required by law.

California law also requires us to disclose how we respond to web browser “do not track” signals or other mechanisms that provide you the ability to exercise choice regarding the collection of personally identifiable information about your online activities over time and across third-party websites or online services. Currently, the Site does not take automated action in response to “do not track” signals.

  • Right to Know. You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources of that information, the purposes for collecting it, and the categories of third parties with whom we have shared it.
  • Right to Delete. You may request that we delete personal information we have collected from you, subject to certain exceptions (for example, information we are required to retain by law).
  • Right to Correct. You may request that we correct inaccurate personal information we maintain about you.
  • Right to Opt-Out of Sale/Sharing. You may opt out of any “sale” or “sharing” of your personal information, including sharing with third-party advertising or analytics partners that may be considered a “sale” or “sharing” under the CCPA, even where no money changes hands.
  • Right to Limit Use of Sensitive Personal Information. To the extent we collect “sensitive personal information” as defined under the CCPA, you may direct us to limit its use to purposes necessary to provide the Site.
  • Right to Non-Discrimination. We will not discriminate against you for exercising any of these rights.
